EU Opens Consultation on CLP Amendments for Endocrine Disruptors and PBTs

On Oct. 27, the European Commission published two draft delegated regulations proposing amendments to Table 3 of Part 3 of Annex VI to the CLP Regulation (EC) No 1272/2008 for public consultation. The revision would incorporate chemicals already identified as endocrine disruptors, PBT or vPvB substances under REACH, plant protection and biocidal products rules into the harmonised classification and labelling system.

The first draft adds notes clarifying classification criteria. New Note Y states that a harmonised PBT classification is not required for octamethylcyclotetrasiloxane (D4) where its content is below 0.1% by weight, shifting assessment responsibility to the company. New Notes 14-17 set out concentration additivity rules for ED, PBT and vPvB classifications in mixtures.

The second draft adds approximately 30 new entries and replaces or updates about 40 existing entries. Substances covered include siloxanes such as D4, D5, D6, UV absorbers, phosphate esters, benzotriazoles, perfluorinated compounds, bisphenol A, phthalates, short-chain chlorinated paraffins and several pesticide and biocide active substances.

Draft Regulation 2 provides an 18-month transition period for industry. The public consultation closes on Nov. 24, 2026. Companies are advised to review classifications, labels, safety data sheets and REACH registration dossiers for affected substances and mixtures.
